Our headteacher says we do not need insurance. Is she right?

Q:

Our Headteacher says that as our events are run jointly by the school and the PTA we do not need insurance as we are covered by association to the school. Is this right?

A:

Unfortunately this is not correct. You do not get 'insurance by association' - think of car insurance. The only way you would be covered would be if your local authority had taken out a policy specifically covering PTAs in your region. Moreover if events are 'joint events' the liability is shared. If someone is injured, it would be up to lawyers to work out how the liability was distributed between the various parties, ie the school and the PTA. You cannot escape your liability by disclaimers.
