Can our Parent Council be a registered charity?

Q:

Can our Parent Council be a registered charity?

A:

Your Parent Council can be a charity and to do that you will have to apply to OSCR - the Office of the Scottish Charity Regulator. You can find out more from their website: OSCR. Your Parent Council will have to pass a 'charity test' and it is up to OSCR to decide if you meet the charitable criteria. We advise Parent Councils and PTAs to think very carefully before taking this step - see our Thinking about Becoming a Charity? leaflet (link below).

With OSCR, we have produced a sample constitution to help you see what you will have to do.  You cannot transfer charitable status from one organisation to another and you cannot 'take over' another organisation's charity number that is no longer in use (see this FAQ).
